BREAKING NEWS:
http://bit.ly/bMvMMl
Breaking: Nat'l rights leader Mr Lopez arrested forced naked videoed by 3 fem LA prison guards
March 26, 4:17 PMHuman Rights ExaminerDeborah Dupre'

This morning, national Human Rights leader and Elder, Mr. Nativo Lopez was arrested, and as thousands of Latinos and Blacks plus others such as FIP Attorney Richard Fine, denied his right to see his original charging instrument when demanding it, and thus held under Contempt of Court. Held with the most dangerous prisoners, he was forced to get naked, then watched and video taped by three female guards in Abu Ghirab and Guantanamo Bay prisons style.

It is estimated that there are up to 30,000 Falsely Imprisoned Persons (FIPs) in LA prisons.

Mr. Lopez is the National Director of Hermandad Mexicana Latinoamericana and National President of the Mexican American Political Association (MAPA).

He has begun a hunger strike.

Mr. Lopez will have another hearing tomorrow morning at the same location, 1150 N. San Fernando Rd. Los Angeles, Ca Dept 95 and needs the reader's support.

He needs support now to help spread the word. His advocates are asking that the reader please notify media and be at the hearing tomorrow to show support.

Me. Lopez's next court date for a Mental Competency Hearing before a judge, as referred by the Commissioner Kristi Lousteau from the last court date in Los Angeles Superior Court is scheduled at Mental Health Department - 1150 N. San Fernando Road, Los Angeles, Dept. 95, Wednesday, February 17, 2010 at 8:30 a.m.

At the last court appearance the Commissioner Kristi Lousteau ordered a mental competency hearing for Lopez to determine if he is competent to understand the nature of the legal proceedings against him.

This occurred after Nativo refused to declare to the court his desire to represent himself or to be represented by private legal counsel, and continued to demand that the court submit to him the original charging instrument (accusatory document from the District Attorney's Office) for his inspection. He has a right to inspect this.

This is the first of many tests by the court to determine if Nativo is capable of sustaining his presentation and rights before the court and provide a remedy to settle and close the matter without the need of exhausting public resources for a trial.

Dr. Joseph Zernik has conducted an independent investigation that revealed alleged massive LA Court fraud involving Court refusal to provide original charging instruments. The writer reported on March 12, 2010:

Dr Joseph Zernik, LA resident, has renewed his call for the immediate resignation of Alex Kozinski, Chief Judge of the US Court of Appeal for the 9th Circuit, for alleged fraud in the June 30, 2009 order issued by Kozinski, together with Circuit Judges Paez and Tallman, on petition by Richard Fine – Fine v Sheriff (09-71692).

Yesterday, Dr. Zernik announced that he has evidence that charging instruments are being fraudulently created:

Millions of Los Angeles residents including up to 30,000 Blacks and Latinos have experienced unprecedented human rights violations evidenced by Dr. Joseph Zernik who now has the smoking gun, documents on the case of prominent LA attorney, Richard Fine, 70-year old, former US prosecutor held in solitary confinement in an LA hospital room for over a year, with no medical justification, warrant, conviction/ judgment/ or sentencing. The evidence has been submitted for the upcoming human rights review.

Among the victims of human rights violations are all of the Rampart- falsely imprisoned persons (FIPS), 15,000 – 30,000 victims of the Rampart corruption scandal (1998-2000), almost exclusively Black and Latinos left falsely imprisoned to this date. (See: Dupre, Zernik's new human rights abuse evidence impacts millions of Angelinos, March 26, 2010)

Attorneys Richard Fine and Ronald Gottschalk had separately filed complaints alleging LA Superior Court judge corruption and were both subsequently falsely hospitalized with no probable medical cause according Dr. Zernik

Among victims of LAs Department of Justice/Court human rights violations are all of the Rampart- falsely imprisoned persons (FIPS), 15,000 – 30,000 victims of the Rampart corruption scandal (1998-2000), almost exclusively Black and Latinos still falsely imprisoned to this date.

To Network-Aztlan: The Neo-Latino

http://bit.ly/b2NHZh

The Neo-Latino

In the early 1990's the U.S. Census Bureau projected the Hispanic-origin population would be the largest growing group. These projections also revealed that by the year 2000, the Hispanic-origin population might increase to 31 million (The official 2000 Census count was 35.3 million/12.5% of U.S. population), to double its 1990 (22.4 million) size by 2015 (that would be 44.8 million), and quadruple its 1990 size by the middle of the next century (89.6 million). In fact, the Hispanic-origin population would contribute 32 percent of the Nation's population growth from 1990 to 2000, 39 percent from 2000 to 2010, 45 percent from 2010 to 2030, and 60 percent from 2030 to 2050. Today this group is the largest minority group in the United States.

Latinos are becoming a social, political and economic force to be reckoned with. My question to readers is - What kind of "Latino" will emerge? Will the next generation have its own identity distinct from the current mindset? My hope is that this community will be transformed into a new type of Latino; the Neo-Latino of the 21st century:

1. Latinos who remember who they are, where they come from, and most assuredly, know where they are going.
2. A Latino who remembers the sacrifice of their parents, and is willing to the same for their own family and others.
3. A Latino who is well educated and affluent but not spoiled.
4. A Latino who is influential in their local community but not conceited.
5. A Latino who understands that the flame of liberty is fragile, and in danger of being extinguished by an obese and unaccountable government.
6. A type of Latino who can lead the next generation with integrity and dignity.

In December 2009, the Hispanic Pew Research Center released a study with the following summary:

"Never before has a minority group made up so large a share of the nation's youth. A new national survey finds that Latinos ages 16 to 25 are satisfied with their lives and optimistic about their futures. They value education, hard work and career success. But they are more likely than other youths to drop out of school, live in poverty and become teen parents. They also have high levels of exposure to gangs. And when it comes to self-identity, most straddle two worlds."

Statistics and research tell a story. These facts paint a picture of the dichotomy of the emerging generation. If you and I remain idle, can you foresee the state of our community by the year 2020? According to the Hispanic Pew Research Center the Latino will either become the business entrepreneurs and community leaders of tomorrow, a small percentage compared to the overall population; or will this emerging generation reflect an undereducated class, impoverished intellectually, socially and financially, and perhaps confined to a prison cell as a result of their involvement with gang related activities? We cannot afford to squander the next generation's promise; it is up to you and I to intervene and redirect their path. The clarion call to action is now; we cannot afford to wait. But how will we reach them? Latino Townhall purposes three objectives.

One of the reasons schools fail to meet the needs of students today is the lack of illumination in education. You can't separate intellect from faith and expect great academic results. The two actually go together (Read: Luke 2:52, Acts 4:13). Stephen R. Covey's best seller The 7 Habits of Highly Effective People lists The Four Dimensions of Renewal, which include giving attention to one's physical, social and emotional, spiritual, and mental nature (Italics mine). Therefore, the whole person's nature must be addressed in education. If public schools remain tentative about spirituality in the classroom, then it's time to start our own private schools for Latinos that will address each component.

Second, a concerted effort from community leaders, clergy and others, within and outside the Latino community, to mentor student's with time tested values that shape a sustainable character that can overcome temptation in private, and maintain one's integrity in the public square.

Third, to provide learning opportunities by exposing students to after school and summer apprenticeship programs where they can experience various workplace environments for the purpose of assessing whether a student's gifts, talents, and passions align with their current career choice. A proactive, hands-on approach to learning will be key in the future when developing the next generation of Latinos.

What will your role be in shaping the next generation of Latinos? From previous experience, people generally fall into three categories: (1) People become passive participants, who think "others" will do the job; (2) People become engaged but only with minimal commitment; or (3) People become passionately committed to make a difference long term. Latino Townhall recommends the latter. Where do you see yourself fitting in?

For more information on how you can get involved with mentoring the next generation email or call us.

Immigration Blueprint Reveals Challenges for Immigration Fairness

Hard Work, Commitment Needed to End Trauma of Current Policies, Ensure Human Rights

OAKLAND, CA:
The "blueprint" for immigration reform recently released by Senator Chuck Schumer (D-NY) and Senator Lindsey Graham (R-SC) points to a difficult road ahead for decent, fair immigration reform. The National Network for Immigrant and Refugee Rights is very concerned that the provisions described by the senators would extend and deepen harsh enforcement practices [http:// http://www.nnirr.org/resources/docs/GuiltybyImmigrationStatus2008.pdf] that have caused trauma and separation for immigration families, fostered racial profiling and led to tragic deaths at the U.S.-Mexico border of migrants seeking a better life.

Surely, the thousands of people who will rally in Washington tomorrow and in local areas in the coming days, want immigration legislation that treats immigrants fairly, that recognizes their dignity and rights. Unfortunately, the blueprint outlined by the senators and praised by President Obama is not an outline for bold and enlightened legislation. As a "starting point" for real congressional engagement, it sets a low bar for the debate, placing harsh and failed enforcement strategies at its heart in hopes of drawing conservative support, regardless of the human rights consequences of such policies.

While still vague and without many details, the blueprint emphasizes increases in worksite and border enforcement as an apparent trade off for a "tough but fair" legalization program. It promises green cards for the "best and the brightest" -- more of the "brain drain" scenario -- and refers to so-called "circular migration" as a rationale to provide temporary worker visas to lower-skilled immigrants to work in the U.S. These workers would presumably save their earnings, send remittances home, and then return to their home countries. This is a recipe for disaster, and merely sets up the prospect of more exploited migrant workers with fewer rights, including workers with little access to green cards and who could eventually become undocumented.

The senators acknowledged that Americans support legal immigration, but did not mention changes needed in our core legal immigration program. Instead, they mention that in "20 years" Americans "will embrace more welcoming immigration policies" after the tide of undocumented has apparently been contained. We hope this does not mean that they are not prepared to support important changes to the current legal immigration program, emphasizing family unity, as part of the immigration package.

It's bad enough that the "tough but fair" legalization program they describe would further criminalize the undocumented and would create unnecessary barriers to eligible applicants.

When President Barack Obama took office in January 2008, we sent him an Open Letter [http://www.nnirr.org/resources/docs/OpenLettertoBarackObama3.pdf Programs] joined by thousands of community members, rights advocates and allies in faith, labor and civil rights communities. We urged the new President to commit to principles of human rights. We asked him to end the raids, detentions and deportations that have caused so much hardship in our communities as a prerequisite to a genuine commitment to provide the undocumented with access to legal status. We continue to urge the Administration and members of Congress to focus on core reforms:

* suspend detentions and deportations while humanitarian policy alternatives are in place, and to reinstate due process;

* support legalization without the onerous hurdles of past proposals that will limit applications;

* uphold family reunification as a core principle of immigration policy, and expand and expedite legal immigration;

* end guestworker programs -- provide access to green cards;

* end the criminalization of immigrants, by repealing employer sanctions, and stopping the militarization of the border and local police collaboration programs;

* strengthen labor law enforcement for all workers, regardless of citizenship or immigration status;

* ensure immigrant access to services.

Immigration is not just a domestic policy issue; it is tied to policies that create displacement and forced migration. In committing to tackle immigration reform this time around, policymakers also need to ensure that U.S. foreign and economic policies promote global sustainable economic development and environments, job creation, and peace, so that migration is an option and not a last resort for economic survival.

Despite the President's and the senators' promises to move forward on immigration reform, we have no illusions about the difficult road ahead. But there is an important step that can be taken now. We urge the Administration to act swiftly to support immigrant community participation in this critical Census 2010. Suspend immigration enforcement [http://www.nnirr.org/resources/docs/CensusLetterFinal33.9.10.pdf] activities so that immigrants, many fearful and unaware of the Census, are encouraged to complete and return their Census forms. This also affects their lives and the lives of us all over the next 10 years. (Read our letter to President Obama and DHS Secretary Napolitano on enforcement and the census here at http://www.nnirr.org/resources/docs/CensusLetterFinal33.9.10.pdf

When President Barack Obama took office in January 2008, we sent him an Open Letter http://www.facebook.com/l/154bb;[http://www.nnirr.org/resources/docs/OpenLettertoBarackObama3.pdf Programs] joined by thousands of community members, rights advocates and allies in faith, labor and civil rights communities.

* suspend detentions and deportations while humanitarian policy alternatives are in place, and to reinstate due process;

* support legalization without the onerous hurdles of past proposals that will limit applications;

* uphold family reunification as a core principle of immigration policy, and expand and expedite legal immigration;

* end guestworker programs -- provide access to green cards;

* end the criminalization of immigrants, by repealing employer sanctions, and stopping the militarization of the border and local police collaboration programs;

* strengthen labor law enforcement for all workers, regardless of citizenship or immigration status;

Suspend immigration enforcement [http://www.facebook.com/l/154bb;www.nnirr.org/resources/docs/CensusLetterFinal33.9.10.pdf] activities so that immigrants, many fearful and unaware of the Census, are encouraged to complete and return their Census forms. This also affects their lives and the lives of us all over the next 10 years.
